Please read these Terms of Service carefully before using www.4peaksparents.com or www.thomasmillercoaching.com (the "Sites") or engaging with any services offered by Thomas Miller Coaching LLC. By accessing our Sites, booking a call, enrolling in a program, or subscribing to our communications, you agree to be bound by these Terms. If you do not agree, please do not use our Sites or services.

1. About Our Services

Thomas Miller Coaching LLC ("Company," "we," "us," or "our") operates 4 Peaks Parents and Thomas Miller Coaching, providing parent coaching services, educational content, and support programs designed to help parents navigate challenges with their tweens, teens, and young adults.

Our services include, but are not limited to:

● The 4 Peaks Parenting Program — a 90-day coaching engagement that includes access to the 4 Peaks Parenting Video Library (23 evidence-based modules), the 4 Peaks Parenting Workbook, and 24 individual coaching sessions (two sessions per week).

● Free Strategy Calls and Discovery Calls scheduled via our booking system.

● The 4 Peaks Parents Podcast — available on Apple Podcasts, Spotify, and other platforms.

● The 4 Peaks Parents Newsletter — bi-weekly email communications containing parenting tips, resources, and program updates.

Blog articles and other educational content published on our Sites.

2. Not a Therapy or Medical Service

IMPORTANT DISCLAIMER: The services provided by Thomas Miller Coaching LLC are coaching and educational in nature and are not a substitute for professional psychotherapy, clinical mental health treatment, medical advice, psychiatric services, or crisis intervention.

Although Thomas Miller holds a Master's degree in Social Work and a license as a Clinical Social Worker, his services under Thomas Miller Coaching LLC and 4 Peaks Parents are offered exclusively in a coaching and educational capacity — not as a licensed therapist providing clinical treatment.

If you or your child is experiencing a mental health crisis, suicidal ideation, or requires urgent clinical care, please contact 911, the 988 Suicide & Crisis Lifeline (call or text 988), or seek care from a licensed mental health professional immediately.

By engaging our services, you acknowledge that coaching is not therapy and does not create a therapist-client relationship.

3. Eligibility & Account Responsibility

You must be at least 18 years of age to use our Sites or purchase our services. Our coaching services are designed for adults in a parenting or caregiver role.

By using our Sites or enrolling in our programs, you represent and warrant that:

● You are 18 years of age or older.

● All information you provide to us is accurate, current, and complete.

● You will keep your account credentials (if applicable) confidential and notify us immediately of any unauthorized use.

● You are responsible for all activity that occurs under your account.

4. Program Enrollment & Payments

Enrollment in the 4 Peaks Parenting Program or any paid service offered by Thomas Miller Coaching LLC constitutes a binding agreement to pay all applicable fees as communicated at the time of purchase.

● Pricing: Program pricing is disclosed at the time of enrollment. Prices are subject to change without notice, except for clients already enrolled under an agreed fee structure.

● Payment Plans: Where payment plans are offered, you authorize us to charge each installment on the agreed schedule using the payment method provided.

● Failed Payments: If a payment fails, we reserve the right to suspend access to program materials until payment is resolved.

● No Guarantee of Results: Results from coaching vary based on individual effort, circumstances, and commitment. We do not guarantee specific outcomes.

5. Refund Policy

Due to the personalized, time-intensive, and digital nature of our coaching programs, all sales are generally final. However, we handle refund requests on a case-by-case basis. The following applies:

Strategy & Discovery Calls: These calls are offered at no charge and no refund applies.

Program Enrollment: Refund requests submitted within 3 business days of enrollment, where no coaching sessions have been conducted and no materials have been substantially accessed, may be considered at our discretion.

After Program Commencement: Once coaching sessions have begun or digital materials have been accessed beyond the introductory module, no refunds will be issued.

Payment Plans: Discontinuing a payment plan does not cancel outstanding obligations. Remaining balances remain due as agreed.

6. SMS & Text Message Communications

Thomas Miller Coaching LLC may send you text messages (SMS) for appointment reminders, program updates, follow-ups related to your enrollment, and other service-related communications.

Consent: By providing your mobile phone number and submitting any form on our Sites — including but not limited to our contact form, strategy call booking form, or newsletter opt-in — you expressly consent to receive SMS/text messages from Thomas Miller Coaching LLC at the mobile number you provided.

Message Frequency: Message frequency will vary based on your engagement with our services. You may receive up to 4–8 messages per month.

Message & Data Rates: Standard message and data rates may apply depending on your mobile carrier and plan.

How to Opt Out: You may opt out of SMS communications at any time by replying STOP to any text message you receive from us. After opting out, you will receive one final confirmation message and no further SMS messages will be sent, unless you re-subscribe.

No Third-Party Sharing: Your mobile phone number and SMS consent will not be shared with, sold to, or used by any third party for their own marketing purposes.

Consent to receive SMS messages is not a condition of purchasing any service. You may use our services without providing consent to SMS communications.

7. Email Communications & Newsletter

By subscribing to the 4 Peaks Parents Newsletter or submitting your email address through any form on our Sites, you consent to receive bi-weekly email communications containing parenting tips, program updates, podcast announcements, and occasional promotional messages.

You may unsubscribe at any time by clicking the "Unsubscribe" link included in every email or by contacting us directly at [email protected]. We comply with the CAN-SPAM Act and will honor all unsubscribe requests promptly.

8. Intellectual Property

All content published on our Sites and within our programs — including but not limited to the 4 Peaks Parenting Video Library, the 4 Peaks Parenting Workbook, podcast episodes, blog articles, graphics, logos, and written materials — is the exclusive intellectual property of Thomas Miller Coaching LLC or its licensed partners and is protected by applicable copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use program materials solely for your personal, non-commercial use as a program participant. You may not:

● Reproduce, distribute, or share program materials with third parties.

● Sell, sublicense, or commercialize any content from our programs.

● Record coaching sessions without prior written consent.

● Use our brand name, logo, or trademarks without written authorization.

9. Disclaimer of Warranties

Our Sites and services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

● Our Sites will be uninterrupted, error-free, or free of viruses or other harmful components.

● The results of using our coaching services will meet your expectations.

● Any information on our Sites is accurate, complete, or current at all times.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Thomas Miller Coaching LLC, its owner, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from your use of (or inability to use) our Sites or services, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from or related to these Terms or our services shall not exceed the total amount paid by you to us in the three (3) months preceding the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless Thomas Miller Coaching LLC and its owner, affiliates, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable attorneys' fees — arising out of or in connection with your use of our Sites or services, your violation of these Terms, or your violation of any rights of a third party.

Our Sites may contain links to third-party websites or services (including scheduling tools, podcast platforms, and payment processors). These links are provided for convenience only. We do not control, endorse, or assume responsibility for third-party content, privacy practices, or terms of service. We encourage you to review the terms and privacy policies of any third-party services you use.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions.

Any dispute arising from these Terms or your use of our services shall first be submitted to good-faith negotiation between the parties. If unresolved within 30 days, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA), conducted in Massachusetts. You waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Changes to These Terms

We reserve the right to update or modify these Terms at any time. When we do, we will update the "Last Updated" date at the top of this page. We may also notify you via email if changes are material. Your continued use of our Sites or services after any changes constitutes your acceptance of the revised Terms.

We encourage you to review these Terms periodically to stay informed of any updates.
